General Terms and Conditions

The following terms and conditions shall apply to all contracts concluded between the customer and Patio Warehouse (Pty) Ltd (PW).  Any conditions stipulated by the customer or any third party which are in conflict with these conditions are expressly excluded.

  1. No deliveries/collections will be allowed until payment for the products has been made in full and cleared by our bankers.
  2. Methods of payment are EFT/Credit and Debit cards. Refunds will be done in the original tender type and the original credit card used for the purchase must be produced for the refund. Please note: Refunds may take up to 14 days to reflect in your account.
  3. A sale is final on acceptance of delivery or collection. You will receive your invoice upon delivery or collection.
  4. All prices contained in the PW’s price lists are subjected to alteration without prior notice.
  5. Deliveries will be supplied by PW subject to your address being within our designated delivery zones and you will be charged accordingly on your invoice.
  6. Patio Warehouse delivery teams will not hoist goods onto balconies or move existing furniture.
  7. Whilst every endeavor will be made to supply the goods on the date stipulated, under no circumstances can liability be accepted for any loss or damage suffered by the customer or any third party by reason of failure to meet delivery commitments. The customer shall accept delivery when delivery is tendered and shall not be entitled to resile from the contract on account of a delay in delivery.
  8. If the customer fails to accept delivery of the goods when delivery is tendered by PW, PW shall be entitled to arrange storage either at its own premises or elsewhere on behalf of the customer. In that event, the goods will be at risk of the customer who shall be obliged to effect payment of all charges incurred in connection with such storage.
  9. Goods shall be examined immediately on receipt. No claim in respect of shortages, damage or apparent defect in the goods will be considered by PW unless notified at time of delivery.  Risk of loss and title passed on to the customer on accepting of delivery/ collection.
  10. Because of the nature of the goods, no warranties are issued in respect of glass, cushions or fabrics.

Website Pricing Errors Terms and Conditions

While Patio Warehouse takes reasonable steps to ensure the accuracy of all pricing, product descriptions, and availability information displayed on patiowarehouse.co.za, errors may occur.

In the event that a product is displayed at an incorrect price, including but not limited to a price that is clearly erroneous or unreasonable (for example, a zero-value price or a price materially below its ordinary market value), whether due to system malfunction, human error, third‑party integration issues, or otherwise, Patio Warehouse reserves the right to:

  • Refuse or cancel any order placed for such product; and
  • Correct any such error without prior notice.

For the avoidance of doubt, all prices displayed on the website constitute an invitation to treat, and not a binding offer capable of acceptance.

A binding agreement between the Customer and Patio Warehouse will only arise once:

  1. A valid order has been placed;
  2. Payment has been received in full; and
  3. The order has been formally accepted by Patio Warehouse, which acceptance may be evidenced by the issuing of an invoice, confirmation of dispatch, or delivery of the goods.

The issuance of any automated acknowledgement, quotation, or pro forma invoice does not in itself constitute acceptance of an order.

Where a pricing error is identified prior to acceptance of an order, Patio Warehouse shall not be obliged to supply the product at the incorrect price.

If an order is cancelled after payment due to a pricing error, the Customer will be notified as soon as reasonably practicable and will receive a full refund of any amounts paid.

The website system’s inability to process or complete a transaction at an incorrect price does not create any entitlement or expectation that such transaction would be honoured.

Customers are expected to act reasonably and in good faith and may not seek to enforce or benefit from prices that are clearly incorrect or unintended.

Patio Warehouse reserves the right to decline any transaction where a pricing error is apparent to a reasonable person, regardless of whether the customer attempted to place an order.

This clause is subject to the provisions of the Consumer Protection Act, 2008 (South Africa), including Section 23 relating to pricing, which recognises that suppliers are not bound by obvious or inadvertent pricing errors, provided that such errors are corrected within a reasonable time.

Lay-By Terms and Conditions

The consumer agrees to:

  1. To buy the goods set out in the lay-by order number
  2. To pay for the goods by making regular payments until payment of the full purchase price, as set out in the Schedule.
  3. Understand and agree that the goods will not be delivered to you and you will not become the owner thereof until you have paid the full purchase price for the goods. The goods will remain at our risk until you have accepted delivery of them.
  4. The required initial down-payment shall be 20% of the total sales value inclusive of VAT and the delivery fee (if applicable).
  5. The purchase price of the goods includes VAT at the current rate of tax.
  6. If, at any time before the full purchase price of the goods is paid by you, the VAT rate is changed in relation to the supply of the goods, we will be entitled to recover the VAT increase from you prior to delivery of the goods.
  7. After your initial 20% deposit payment, will you receive a monthly link to make your next payment.

Terms of agreement:

If you terminate the Agreement before paying the full price, or fail to complete the payment for the goods within 60 business days after the Lay Bye completion date we:

  1. Will charge a termination penalty of 1% of the full purchase price of the goods. We will not charge a termination penalty if sufficient proof is made available to us that your failure to complete payment was due to death or you being hospitalised.
  2. Will, after deducting the termination penalty, refund you any amounts paid by you under this Agreement.

Contact Details:

  1. It is your responsibility to provide us with the correct contact details and address and to inform us of any changes.

Delivery of the Goods:

  1. We will make every reasonable effort to deliver the goods, if applicable, to you as soon as possible after we have received the full purchase price of the goods at the address in this agreement.
